For me it looks like the customer does exactly this: he's not accepting
the Radio as a replacement.

The dealer offered the Radio and the customer answered that he accepts
it only if he gets the (unrepaired) Touch back. If the dealer didn't
agree he should not have sent the Radio while keeping the Touch.
