Private contracts are indeed subject to local, state, and federal laws.? In 
other words, you can't enter into a contractual agreement that is against the 
law, even if all parties agree.? However, in this case, it will be?years before 
the attorneys come to agreement, assuming they try...

What you are missing is the reference to 47 C.F.R., Section 97.15(b) which is 
the FCC rule. It specifically mentions that HOA's and CC&R's are private 
contracts and not subject to FCC regulation.

antenna support structures shall comply with the requirements of 47 C.F.R., 
Section 97.15(b), as amended from time to time, by allowing for the erection of
