I believe that Seb is correct.  I dug into this a few years ago pretty hard.
The way I remember it is that if you purchase the Tormach product that 
includes the software, they are legally required to supply you with the 
source code IF you request it.
They are not required to give it out to the general public or put it on 
a website, etc...

Siemens apparently uses quite a bit of open source software in their HMI 
- operator screen products.   I do quite a bit of Siemens related work 
and their HMI devices always come with a small CD that contains the 
source code and licensing info.

Having Tormach involved with LinuxCNC and Machinekit seems to have had a 
very positive impact on both projects.
