Clearly, if we are _only_ talking about a port scan then you are joking right?
Is this the state of where things are going! I doubt that many on this list would
consider a port scan worth the effort of criminal prosecution, or any prosecution for
that matter. Legal issues aside, can you imagine the costs that could be incurred the
investigation into the criminal case or YOUR costs for retaining a lawyer capable of
handling the civil case. IMHO a port scan should not be considered an attack, it's
like driving around the neighborhood to see who has left their windows open... what
you do with the information after that point is where the line is drawn.

How about making it illegal for the culprit to go anywhere near a computer
for two years (punishable by prison). Put them on probation. This would have
a knockon affect of (in some cases) making certain people unemployable for a
while (if their job involves computers). Confiscate all hardware for the
duration and delete all know internet accounts etc. You could even
distribute lists to all known (local) service providers making it an offence
to provide a connection to anyone on that list.

Hm. How about having to listen to lots of people on a mailing list
dredge on about a topic which can only end up in the eventual consultation
of someone who knows the law pertaining to a given geographical area? :-)
Just think of how many portscans you folks are missing while typing!
