I agree that scanning the source of an attack is not justifiable,
on the other hand how do you handle scenarios (in court) where
firewall
administrators have configured their boxes to scan back
automatically,
the host that the attack is originating. It acts as a booby-trap.
It's almost the same idea as surveillance cameras that take pictures.
If a criminal has committed a crime with someone else's car it does
not
mean that you violate the law by capturing his actions with a camera,
even though he is using some one else's vehicle. You are not
violating
the privacy of the rightful owner.
