I agree with Bill 100%  It IS that simple.  A scan is a
"light" intrusion and trespass.  It is an intelligence
gathering technique.  Lets face it, the majority of
system cracks began with a scan of some sort.
Egoslayer1 implies this fact in the following:

Personally I don't have the time to constantly monitor someone
until they escalate above a scan and begin a full scale assault.
