That's not quite true. The FreeDOS kernel itself is GPL (v2), but compiling with OpenWatcom isn't forbidden or illegal at all. OpenWatcom is officially OSI ("open source"). FreeDOS and SourceForge have no problems with it. It's only some people (FSF, Debian, Red Hat) who dislike it because they say it's not "free software". In other words, it's not worth worrying about. Well, worrying and complaining won't change anything.
