In a perfect world ;) You could try and persuade them to open source
their code under another license, one which prohibits sale and
distribution but not derivative works. I wrote a basic one of these
years ago for some code I had which basically ensured all patches had to
come back to me or my copyrights were violated. Anyone can slap any
license they want on code if its theirs.

Maybe you don't even need code, you can run unversioned kernel code, and
do various other things to get binary stuff working else where.
