it was a new drive, it was specifically listed by model number on maxtor's web page as being covered by their "no quibble" warranty, it took several months, emails, and phone calls to beat a drive out of them. the initial response was that they didn't make that model drive anymore so they couldn't help me! they made no offer of any sort other than threatening to sue me at one point. ymmv, but in my case they were bung holes all the way.
