Speaking of "taking photos," anyone follow that Nestle Coffee court case?

A model did a photo shoot in '86.  In '02, he sees his picture on a coffee
jar in the store, decides to sue Nestle for "unauthorized use" of his
picture.

Nestle offers $100,000 to settle, the model makes a counter offer of around
8 million.  As of right now, the settlement is $15 million and change,
pending appeal.

Damn.

The aspect of the case I wasn't clear on is: AFAIK, usually models sign a
release that basically says the photographer can do what he wants with the
pics.  Are they entitled to additional compensation?  Or did the original
photographer not make sure a release was signed, or???
