The data is constructed with TAG TEXT pair. So, may be the EMPTY is here for consistency (TEXT is not empty). Anyway, there are more potential problems still unresolved, for instance: http://feature.opengeospatial.org/forumbb/viewtopic.php?t=325 (I've not got any confirmation to my questions here, except the one from creed user, so I have no idea if they have been considered by the board or not).
