Now I think we're more together. Your system ultimately provides the end user with the ability to define spam for themselves and also provides ample flexibility with regard to errors.
As for your wonderings... you can bet that there are a lot of hotshot lawyers wondering that as well, which is why it is critical to be up-front about filtering in your AUP/TOS. Users must know that messages might be filtered and must agree to hold you harmless.
