Let me try this again:

Because 209.164.0.0 - 209.164.63.255 includes 209.164.21.36, which is your
IP.  And that's exactly why you are involved in this.  Let me explain.

IPWHOIS list network blocks.  In this case, your ISP is DELTANET.  They
have the IP block 209.164.0.0 through 209.164.63.255.  Since they haven't
sub-delegated any of those IPs, both you and the spammer are grouped
together.

You could ask your ISP to sub-delegate your IPs.  But, if they are hosting
a known spammer, they probably aren't going to take the time to help
you.  I'd switch to another provider if I were in your situation.
