Darin, Morality and Ethics are molded by what we can and cannot do or get away with. It's a sad fact of humanity.
There is a reason why fighting back is a popular option. Governments do a very poor job of policing technology. Spammers spam because they get away with it and it is profitable. Email Admins are always in a reactive mode in trying to stem the tide of crap that comes in. We end up spending huge amounts of time and money fending this stuff off and the Spammers are always one step ahead and always will be. No government/company has been able to step up and wipe these people out. We see token lawsuits and token enforcement. It's near enough to anarchy to persuade many to fight back. At this point maybe that is what needs to happen. Make them filter their systems and spend hours maintaining and money on systems to deal with the flow. If it ceases to be so easy and profitable they might give it up. Is it Ethical? Hard to say.
