That is incorrect; the proposed guidelines would allow them to use the name with the single restriction that they could not call themselves "OpenSolaris." Sun is not the one using the trademark here; Sun is allowing an OpenSolaris.org project called "Project Indiana" to use the trademark to represent their project.
