Election-returns: Supervisory Body repudiates KPU's Action

Jakarta, July 26 (ANTARA) - The Central General Election
Supervisory Committee (Panwaslu) has formally repudiated the
General Election Commission (KPU)'s action in putting the question
of validating the final returns of the June 7 polls in the hands
of President BJ Habibie after 27 political parties had refused to
endorse them.

"The KPU's action is a violation of provisions in the law on
general elections (No 3/1999) and Government Regulation No 33/1999
on the law's implementation," the Panwaslu said in a letter it had
faxed to the president, according to Panwaslu first secretary Moh
Adhy S.

"In the letter signed by Panwaslu chairman Soedarko we expressed
our objections to the course of action taken by the KPU," he said.

"In addition, that act tends to eliminate the positive efforts
made by all involved in the organization of the general election
from village to central levels, and also the millions of voters,"
Adhy said quoting parts of the committee's letter.

The Panwaslu had also noted that the KPU had let down the millions
of voters who had shown their political maturity, enthusiasm and
active participation in the general election.

"By referring the problem to the president, the KPU is denying its
own existence as the institution empowered to officially declare
the general election results," Adhy said.

Illegal KPU Decision

Panwaslu also took issue with the KPU's action in issuing its
decision No. 141/1999 on the methods to be used in validating
results of the vote count. In formulating the decision the KPU had
ignored stipulations in Government Regulation No. 33/1999 was
implemented as it should be.

Meanwhile, Panwaslu had also asked the parties that had refused to
endorse the election returns to give clarifications on the reasons
of their refusal and if they objected because violations had been
committed, they had to specify what kind of violations, who had
committed them and who had suffered by them.
