JUBA, 16th August, 2011 [Gurtong] - The Supreme High Court of the
Central Equatoria State yesterday adjourned for the second time, the
ruling over a case in which South Sudan Director of Public Security
and Criminal Investigation Maj. General Marial Nuor Jok is accused of
several counts of crimes.

Justice Malek Mathiang Malek, the Central Equatoria State (CES)
President of the High Court told Gurtong shortly after the adjournment
of the case that, “the verdict is not yet determined until tomorrow.”
The case ruling is expected today.

He clarified that the case required critical and deep scrutiny that
needs no hurry. “This is something that cannot be done in a hurry, we
all know that ‘Justice hurried is justice denied’ like justice delayed
is justice denied,” Malek told Gurtong.

During his first trial last week, the embattled Public Security
Director and Criminal Investigation at the Ministry of Internal
Affairs’ defence lawyer, Mr. Kiir Chol filed several complaints to
stop the Judge from ruling over the case.

Kiir demanded the presence of the accused Maj. General Marial Nuor in
the court before any ruling could be made. According to Kiir, his
client’s health status is not known.

He also said that, the detention of Mr. Nuor is illegal according to
the South Sudan Police Act 2009. The defence lawyer has also accused
authorities of blocking Nuor’s family from visiting him.

Nuor was arrested under the orders of Tito Acuil, the South Sudan
Inspector General of Police on allegations of several crimes.

According to Acuil, Nuor was arrested on allegations of the
disappearance of one, John Luis in April 2011, following reports that
he was summoned to the office of the Chief Public Security and
Criminal Investigation Department over a disputed plot of land,

He was also detained over accepting bribes for assets such as houses,
shops, plots in return for cash and shops in Konyokonyo area,

Permitting the arbitrary arrest of civilians in illegally created
public security detention facilities, extortion of money from families
of innocent citizens,

Arming his tribesmen with guns to perpetuate tribal and sectional
disputes in Yirol West and East Counties in Lakes State, and

The illegal incorporation of active Sudan People’s Liberation Army,
SPLA officers and other ranks who are not police personnel and who
have not obtained official release from their parent units to join any
institutions including public security and criminal investigation
departments.

When asked whether the case will be finalised today, Mathiang
expressed confidence as he responded, “obvious.”
