On what basis is this true ? If you are such a stickler for the letter of
the law and the rules, that you can claim that everything is OK because
Bates hasn't strictly speaking broken any (not my words), then you cannot
suddenly ignore your own arguments when it comes to this rule.
The club cannot provide the CVA which is required in order to regain the
golden share. By your own way of playing the game then the game is over and
the club is dead and buried. What you state is in fact the oppposite of what
is true. In fact there is no reason FOR the FL to give Leeds the GS. There
is an unusual circumstances clause which has never been applied before, but
of which the FL were very obviously mindful, but if it had been applied then
the conditional elements of bids would probably mean that Bates would have
lost the bids. If the use of this clause for the first time has been blocked
then who do you think will have blocked it ?
The application of the rules as they have always been applied previously,
means that Bates did not lose the bids but it also means that he cannot meet
the usual criteria for the GS. The right of the club to play football may
have been sacrificed by our saviour so that he did not lose the bidding war.
Such a tactic does not appear to me to be at odds with what has been said
over the last few weeks. None of this is known for certain but more will be
known if and when the bid details are released. If it turns out that another
bid was higher than Bates' but depended upon the unusual circumstances rule
being used then conclusions may be drawn. If the FL couldn't use it then,
why should they use it now ?
