I'm not sure if the following answers all your questions, if not please come 
back.

Legacy will only ask if you wish to back-up if you have changed the file during 
the session. If no changes have been made then you will not be asked.
 
It does not remember if you have backed up during your session and if changes 
have been made you will be asked if you wish to back-up. It does not matter 
which way you exit. I regularly back-up using the Icon during long sessions and 
even if no changes have been made after the last back-up, I will still be asked 
if I wish to back-up - I just click "Skip".
