Re: Informal consultations for the preparation of the resumed session 
of the first extraordinary meeting of the Conference of the Parties 
for the adoption of the Protocol on Biosafety to the Convention on 
Biological Diversity (ExCOP), Vienna, 15-19 September 1999.


As you may be aware, H.E. Mr. Juan Mayr Maldonado, Minister of 
Environment of Colombia and President of the first ExCOP Meeting 
chaired an informal consultation in Montreal on 1 July 1999 aimed at 
planning for the resumed session of the ExCOP to adopt the Biosafety 
Protocol. At this meeting, representatives of all of the negotiating 
groups expressed their commitment to the conclusion of a Biosafety 
Protocol and confirmed that there exists the political will to have 
the Protocol. To this end, it was agreed that, an open-ended informal 
consultation involving all Parties and Governments, which have 
participated in the negotiations on a Biosafety Protocol, would be 
held in September 1999.  The results of the informal meeting of the 1 
July 1999 are contained in an Aide Memoire from Minister Mayr, which 
is available at the website of the CBD (www.biodiv.org).

I am pleased to inform you that these consultations will be held from 
15-19 September, 1999 at the Vienna International Center, Vienna, 
Austria. It is important to note that this meeting will consist of 
informal intergovernmental consultations on how to move forward on 
possible solutions to outstanding differences regarding the draft 
Protocol, but should not in any way be interpreted as negotiations as 
these will only take place when the Extraordinary session of the 
Conference of the Parties resumes at an appropriate time. The 
proposed format for these informal consultations, which will be held 
over a five -day period, is as follows:

i       the first two days would be devoted to consultations within 
the Groups that emerged from the ExCOP meeting in Cartagena, 
Colombia, namely, the Miami Group, the European Union, the Central 
and Eastern European Countries, the Compromise Group and the Like- 
Minded Group of Countries. Such consultations were deemed necessary, 
especially for the Like- Minded Group of Countries, as they have no 
opportunity to meet outside of formal meetings of the Convention.

ii      the third day would be set aside for informal exchanges 
between the Groups;

iii     the last two days would be devoted to informal consultations 
involving all Groups aiming at clarifying differences on the pending 
core and related issues in the draft Protocol and, insofar as is 
possible, reaching understanding on possible solutions to key 
outstanding issues, under the chairmanship of Minister Mayr. The 
structure of the meeting for these last two days would follow the one 
used at the ExCOP1 meeting in Cartagena. This would mean that only 
government representatives can be present and  only the designated 
spokespersons from the five Groups will be making interventions.

The Aide Memoire of Minister Mayr sent to all governments, states, 
with the understanding of all Groups represented at the consultations 
held on 1 July 1999, that the agreement reached in Cartagena as 
outlined in decision EM-I/1, would be the basis of the forthcoming 
open-ended informal consultations and of the resumed session of the 
ExCOP1 Meeting.  Accordingly, the informal consultations in Vienna 
will focus on the pending core issues and related issues as contained 
in document UNEP/CBD/ExCOP/1/L.2/Rev.1 of 23 February 1999, taking 
into account the statements made by Governments as reflected in 
document UNEP/CBD/ExCOP/1/2 containing the report of BSWG6. This 
document will be available at the venue of the meeting in limited 
numbers and participants are therefore encouraged to bring their own 
copy. These documents are also available at the website of the CBD 
(www.biodiv.org).

The Bureau of the 4th Meeting of the Conference of the Parties, in 
accordance with its mandate to prepare the resumed extraordinary 
session, has agreed to hold these consultations on the understanding 
of all Parties that these are not a formal meeting of the CBD, and 
therefore are not intergovernmental negotiations. Intergovernmental 
and non-governmental organisations (IGOs & NGOs) which might wish to 
be present at these consultations are most welcome to do so, on the 
basis of the same understanding. The meetings within and between the 
above-mentioned groups of countries, and the meetings of the 
President of the ExCOP1 Meeting with representatives of these groups 
will follow the same arrangements as at Cartagena. Minister Mayr, 
President of the ExCOP1 Meeting, has indicated that he will be 
willing to meet with representatives of IGOs and NGOs to brief them 
on the consultations.

 I would be grateful if you could inform the Secretariat, as soon as 
possible but in any case not later than 6 September, 1999, of the 
name and address of the person who will attend these consultations on 
behalf of your organisation.

Please note that due to budgetary constraints, the consultations will 
be conducted in English only and the Secretariat will not be in a 
position to provide rooms and/or other facilities to IGOs and NGOs. 
Should your organisation require rooms or other facilities, we
