"Why?" is a rather broad question that goes to IBM's business decisions. I
don't know why our license agreements are written the way they are.  I am
not a lawyer, although I do quote them as needed (as in this case).  :-)

As a technical guy, I can say that licensed versions of S/390 and
z/Architecture go through rigorous testing to ensure their conformance to
the specification, as well as testing with the operating systems before
IBM gives its blessing.  We software guys aren't interested in spending
brain cycles wondering if a problem is caused by a poor implementation of
the instruction set or by the software.
