Absolutely not.  To add either of these nebulous and unquanifiable
criteria to the definition of spam renders it unworkable in both a
practical and legal sense.

Again: the correct definition of spam is UBE, "unsolicited bulk email".
Anything which meets this criteria is clearly spam, regardless of
intent, regardless of how it's received, regardless of content,
regardless of the number of complaints.
