Bella is incorrect in any case. A law, that stands in opposition to higher law (eg, a muni ordinance that violates state law) is invalid. While you may be charged under such an invalid law, and even jailed, governments do bad and wrong things under colour of authority. That doesn't make it right, or legal.
The practical matter of being punished by the judicial process still hurts, but the law is still invalid. Bad laws should be fought, only by fighting them, will they be corrected.
