Default opt-in is a violation of the GDPR, period. Even pre-checking the
opt-in box is. (Yet I still see many companies do this anyway). The GDPR
website says (https://gdpr.eu/gdpr-consent-requirements/ ): "Consent must be
unambiguous. That is, there should be no question about whether the data
subject has consented. “Silence, pre-ticked boxes or inactivity should not
therefore constitute consent,” according to GDPR Recital 32." So I think
it's totally OK to consider the mail sent because of default opt-in as spam.

(Even non-European companies, if they provide services that are available
to European customers, are subject to GDPR).
