for various reasons (some technical, some not), the reference kernel is based on 2.6.37 (even though 2.6.39 will be released before MeeGo 1.2 is). Specific platforms can choose obviously to have a different version; if a platform picks a newer version this is obviously within the compatibility requirement; if it picks an older kernel it'll need to backport any and all critical features that we depend on.
