should really describe the reference ABI there...

out-of-tree kernel modules for a 2.6.38 adaptation kernel?
If "no" -- then that's the problem.
you can never use a kernel-headers package for building kernel modules
of any shape or flavor...
since these are the headers for glibc, they're not the kernel sources
needed for kernel modules.
(and never were).
