They would have to mandate it. Of the places where I’ve lived that had off-peak 
metering where they can load shed when necessary, the programs have all either 
failed or been discontinued.  My current home has such a setup for my AC, which 
I removed when the new AC was put in.  I called the utility to ask if they 
wanted their box back, and after they began to harass me for “tampering” with 
it, I pointed out that I wasn’t in the program and the program sunsetted like 
10 years ago.  “OK, just throw it away then.”
