Unfortunately, I'm from a state (NY) where you can be convicted of manslaughter for shooting someone in your own house. In NY State, if you kill someone in your home and you had a path of escape (back door, etc.) or if you kill an invader with a handgun & he only had a knife then you will be prosecuted & will likely be found guilty.
Fortunately, I now live in a state (Alabama) that believes you have the right to PROTECT YOUR PERSONAL PROPERTY and if need be, can shoot an invader. And if he happens to die from a gaping 45 ACP wound, it's considered a result of his own actions and HIS FAULT. And if he was only carrying a knife when he broke in? Then he's incredibly stupid, but still dead. The police report usually states "no charges filed" & everything is dropped. One should also make sure the perp falls into the house. Even if you have to help him in once he is limp. Makes for a better defense. clay On 13 Aug 2007, at 15:15, Donald Snook wrote: > Clay wrote: > > > > "This needs to be on the quotes page with Mr. Snook Esq. tag line. > > Advice for client's of his?" > > > > Actually, I got that advice from someone who cleaned up crime scenes. > The police in Springfield, Missouri would often recommend this guy > when > someone needed an especially gruesome scene cleaned. > > > > As to the advice to my clients I remember some wise words from one of > professors.
