OK - I thought about not posting copyright info this after I first posted
and actually replied to a couple people off-list. 


Obviously, any text material that is completely original and created by you
your students can be used however you want.

First a disclaimer - I'm not the copyright police or a copyright lawyer.
While working at a local university I did work on posting streaming music
from CD's for music dept. courses and so had to get a handle on DRM. 

Here's my understanding of copyright and digital rights management (DRM)
that would apply to K-12 classroom use:

If the book is copyrighted, then it would be OK to:
        * Make a digital, read-aloud MP3 file available in your classroom.
You could let kids put on their devices with the understanding that they
would DELETE the file when done with course or unit.
        * Put a copy on website provided that the students had to enter a
password to get to the file. Again, the file would be for student use as
part of your classroom and DELETED upon end of course or unit.

With pre-recorded "books on tape" you should be very strict in following the
law. I'm pretty sure the above also applies to this medium. So the basic
rule of thumb is that you are OK with making these audio files available as
long as it is:
        1. Limited Duration - available as part of a 4th qtr reading class.
        2. Limited Access - only people in your class can access the file.
        3. DELETED upon end of course or unit.
