Strangley in my experiance it is not (2). 
Piracy is considered a 'victimless' crime by many
and I have had people skite to me ho they have pirated
software (and they know what I do for a living)

The most effective arguement to someone who 
runs a company is the ethical one, ask them if they
consider themselves ethical (and these people do)
because they 'intend' to legalise their software its just
there is no impetus to do so
