Sun is using the trademark for Indiana (likely) and simultaneously
seeking input from the community on ways they would like to be able to
use Sun's trademark.

They're allowing the community to help establish the guidelines that
will apply to community distributions.

I don't see any discrepancy or "one hand/other hand problem" here.
