Faust,

I understand your dilemma.  I would suggest that your
product line that is compatible with any DnD setting
can be earmarked as a "Fantasy Adventure Ready to
Play."  "Requires use of DnD3e PH."

Your Fantasy RPG products set in 1066's unique fantasy
setting could be marketed by emphasizing the setting
itself, perhaps by tone and style; the d20 logo and
the "requires use of" notation will indicate DnD rule
compatibility.

Your non-fantasy products using d20 could likewise
empahsize their setting (old west, superhero, etc..)
and bear the d20 logo.

The above could be done without the need of any
trademarks other than 1066's company TM and the d20
logo.  

That may sound simplistic, but having the d20 license
gives you an edge (whether the license is limiting or
not) that would not exist absent the non-existence of
the license.

That's my 3 cents worth, and I will be glad to
continue brainstorming with you.
