The loophole is that the STL does not specify where the phrase:
"Requires the use of the Dungeons & Dragons(R) Player's Handbook, Third 
Edition, published by Wizards of the Coast(R)" can appear and how large it 
can be.  I could, for instance, put

"Requires the use of ..."

in very small type at the top of the front cover in dark letters on a black 
background, then put

"Dungeons & Dragons"

in bright red letters four inches high so it takes up the entire cover, and 
then put

"(R) Player's Handbook, Third Edition, published by Wizards of the Coast(R)" 
in very small dark letters across the bottom.

THAT would send a clear message to my market.  The message might be that I 
was an idiot, but it would clearly be misleading.  The general consensus on 
this list has been that this "loophole" will be closed before the STL is 
final.
