I think every reasonable person has agreed that a conservative
approach such as keeping all artwork and your 5 page background
story closed while opening things that derive closely from the
d20 SRD would be acceptable use.

If your text is all original, of course you can close it.
People could be hesitant to say your text can be closed without
seeing what your text looks like. It could be a total rip off,
infringe on trademarked names, etc.

I *really* doubt WotC will go to bat for your closed material
against others.
