I'll be the first one to tell you to hire an attorney
regarding any questions you have. IP is certainly not
my specialty, though I have consulted several
practitioners in this area.
Many of the arguments I have heard on this list are
legally unsound and based on cases that do not stand
for the propositions for which they are being
advanced. I would encourage everyone not to make
business decisions based on a laymans understanding of
the law in this area.
In addition, I have never claimed that my opinion
somehow holds more weight than anyone else's just
because of a law degree. Someone else made that
statement. I will, however, tell you that I do have
the advantage of being able to read a case properly
and inform people that they are misconstruing cases.
