I believe there's a different reason: to maintain a legal distance between
our Open Game Content and the D&D trademarks. Notice that it is NOT the "D&D
SRD"; it's the D20 SRD. In this fashion, they are freer to prosecute someone
who truly infringes. "But your honor, they did not prosecute Mr. Peterson
for his product!" "Your honor, that is because Mr. Peterson's 'Creature
Collection' is designed for our open D20 product, and uses none of the
trademarks in question. The defendant has not complied with the terms of the
open license, so no license is in force; and the defendant has used our D&D
trademarks, which are not available under the license Mr. Peterson accepted.
There is a clear distinction between Mr. Peterson's legal use of a license
and the defendant's illegal derivation and illegal use of trademarks."
