You do not need to 'register' a copyright. Anything which you create which
is original is copyrighted. The cratures noted are, with the exception of
the displacer beast, original to TSR/WOTC, and thus are copyrighted.
Now, you can't copyright an idea, and Ultima Online has "Gazers" which are,
basically, Beholders. However, there's no law specfiying what WOTC has to
release as open content; they have free reign to open their material or
not, as they see fit. (For example, look at how many artifacts are NOT in
the SRD.) You can, of course, attempt to use normal copyright laws and
create your own version of 'squid headed humanoids with mental powers', a
non-copyrightable idea, but doing so leaves the 'safe harbor' of the SRD
and exposes you -- and anyone who derives from your work -- to lawsuits.
