Yes and no.

From Section 7:

"You agree not to indicate compatibility or co-adaptability with any Trademark or Registered Trademark in conjunction with a work containing Open Game Content except as expressly licensed in another, independent Agreement with the owner of such Trademark or Registered Trademark. "

So, you can use someone's trademark--but only if it's not in reference to their product. (i.e., you could have someone say "Beauty is in the Eye of the Beholder" without WotC complaining.)


If you really want to use the non-released monsters, either:

1: Use an OGC equivalent
2: Ask special permission from WotC.
