I'm with the "Get Permission" camp. :)

However, even if it were okay, would you just have those statblocks in your
module? Very unlikely. You'd have text describing their actions, appearance,
etc. And at this point warning bells start ringing saying "derivative!
derivative!"

I'm convinced that the removal of these monsters from the SRD is, in part,
designed to stop us from using a considerable body of lore that WotC/TSR has
developed for them. The intention of the license is that we can use anything
in the SRD or in common lore, but not reference other material (background,
setting, etc.) owned by WotC.
