Not to put too fine a point on the obvious, but the original intent was
not to accomodate 'weasely' behavior.  Try it and it more likely than
not you will be the loser in the war of words.  They have the upper hand
by virtue of being the entity granting the priviledge of the use of
their logo and even if they were in a shakey legal position, justice
ain't blind to money, and I'll bet Hasbro's got way more than you or I. 
Personally, I wouldn't even consider trying anything thet you see up
front as weasely.

The product you've described so far fits fine under the OGL, just not
the d20STL.  Under the OGL you can have as much in the way of character
creation as you'd like.  It is the STL that introduces most of the real
restrictions.
