Australian Hicks Gets Nine-Month Prison Sentence for Terrorism

March 31 (Bloomberg) -- Australian David Hicks was sentenced to nine months
in prison after pleading guilty to terrorism charges, the U.S. Department of
Defense said. 

A panel of military officers recommended a maximum sentence for Hicks of
seven years, which was reduced as part of a pre- trial agreement, the
department said in a statement yesterday on its Web site. The sentence will
be served in Australia as part of an agreement between the two countries, it
said. 

Hicks, 31, pleaded guilty on March 26 to providing material support for
terrorism as part of a plea bargain. The Australian and U.S. governments
reached an agreement in May 2006 to transfer prisoners sentenced by military
tribunals to jails in their own countries. 

``Hicks will be transferred to the control of the Australian government
within 60 days,'' the department said in the statement. 

Hicks, captured in Afghanistan in 2001, is the first detainee at the
Guantanamo Bay base in Cuba to be charged under a 2006 U.S. law authorizing
military commissions to hold trials for enemy combatants. About 385 inmates
are held at the base. 

Hicks admitted to 35 facts that supported the charge of providing material
support to terrorism, the U.S. defense department said. These included
training at multiple al-Qaeda camps in Afghanistan and joining fighters at
Kandahar airport and frontline forces in Konduz after the terrorist attacks
of Sept. 11, 2001, it said. 

The Australian government has no power to commute the sentence, Australian
Foreign Minister Alexander Downer said today. 

``The sentence would be carried out fully,'' Downer said in an interview on
Australian Broadcasting Corporation radio, according to a transcript on the
broadcaster's Web site. ``And I say that with a bit of passion, because we
take a very strong stand against terrorism.'' 

Hicks will probably serve the sentence in a prison in Adelaide, Downer said.
