I use Zenfolio. I like that there is a plug-in for Lightroom that
allows me to resize/rename/export directly to Zenfolio (also true for
Picassa I believe).
The Selling part is quite unobtrusive, and unless you tell likely
visitors about it, they are likely to never find that functionality.
No ads, no clutter. Very controllable folder structure. Unlimited
storage (if you pay full price). As far as TOS, I figure like others
on the list that anything that leaves my hard drive is effectively in
the public domain, whether I approve or not. So I don't put many high
resolution images out there. I don't think Zenfolio claims any
ownership but I just skimmed through the TOS - see previous comment.

At least in the US, I'd expect you to find reasonable TOS from many
of the providers that focus on generic hosting (rather than
specialized sites like Flickr). For example, I've been using
pair.com for a number of years, but they're just an example of many
services out there. Their TOS requires that I indemnify them
against liability from the stuff I post (allow to be posted),
criminally and under tort, and they reserve the right to delete
criminal stuff if they notice it, but otherwise I'm open ... no
attempts to expropriate my IP (photos, writings, etc.) beyond the
rights required to disseminate it in the first place.
