it probably depends on where you are. I think that in the EU it's ok to buy OEM software (disclaimer: this is an opinion - not legal advice!). However, whether the software advertised as OEM really is, or whether it's a pirate copy, or whether there is any software at all rather than just a means of taking your credit card details, is something else entirely.
