Most board houses automatically apply a solder mask => silkscreen overlay
function that removes any silkscreen that would wind up on the pads or vias.
(This sometimes is a pain, as I'd just as soon have the silkscreen show over the vias,
but because of tenting worries or testing access, they take it away.)

So, I don't think you need to worry about this.
