P99SE is not the only one with problems in that area, I've seen it with 
older programs too.
Most of the times when I come across it switching to the top layer 
beforehand helps. At least for me ;)
Could it be that the component on the top is locked? Just a wild guess....
Beware though, DRC might have a problem with the pad centers aligning 
perfectly, too. I once lost a board that way...:(
