What does it say when it's failing on the iPod? Is it during
installation or when you try to get it from the store?

You are logged into the correct App Store account and don't use a
jailbreak?

I will never understand and have given up all attempts to do so, the
logic behind syncing in iTunes. IMHO this is completely and hopelessly
broken and should be used as little as possible since it only causes
pain and confusion.
The obvious exception is creating backups of your Apps :)
