Wrong again, Little Mike.
In fact, Berg, the plaintiff, filed a "Motion for Summary Judgement"
in Federal District Court of Eastern Pennsylvania today. In essence, a
Summary Judgement is in lieu of a trial, in this case because Obama et
al failed to respond - notwithstanding his motions to dismiss. Failure
to respond to the material particulars is construed under Rule 36 as
an admission to all charges made by the plaintiff (Berg).

The judge may or may not rule in Berg's favor, but the call for a
summary judgment will expedite the court's response. Probably by
tomorrow or Friday.
In addition, similar actions are underway in the states of Washington
and Hawaii, with Virginia coming into the fray.
