Premeditation is the fact that a crime was a result of "cool and/or calm reflection and not done in a moment of uncontroled passion". The REASON for the premeditated 1st degree murder MIGHT save you from the death penality and get you life with no chance for parole, but it's unlikey as all hell to save you from the CHARGE of 1st degree murder. What is it with you lads? Still all pissy about "hate crimes" legislation or that people can be charged with "violation of one's civil rights" under Federal statutes that supercede state laws?
