Not to put too fine a point on it, but the crime is intensified by
things like pre-meditation and now, thanks to libs, motive. The law
has always considered a crime of passion or of the moment less serious
than one pre-meditated. Now it considers the reason for the crime as
dispositive. The sentencing portion and the crime charged are
interlinked. I'm not even sure why you're arguing against this.
