Fred, The Sections and clauses of the Constitution that you mention have been amended The Constitution is not the "living, breathing document" that so many far left extremists would like for it to be, and try to persuade the American public that it is.
The Constitution is literally "black and white", there is no gray area. It outlines not only what government's limited role is, but the framework of how the proverbial "checks and balances' between the three branches of government are to work. The Constitution is also a check on all public servants, who are required to take an oath to uphold the Constitution.
